<p><strong>Answer:</strong></p>
<p>Why are they calling you back? Did they realize they were in the wrong? You really need to discuss that with your attorney. Maybe you can work out some out of court monetary settlement, in addition to some ground rules and training for the management so the vaccination sticks and they don&#8217;t do it again.</p>

<p>If your manager comments on your body&#8230;he told me that I should be a courteous clerk. I said I did not want to be because I thought that job was to masculine (lifting all the heavy stuff, and I was joking). Anyways, he said that I had a nice built, nice thick legs and arms&#8230;then he kept playfully touching me. He was also saying that I am gorgeous, and bla blah blah.</p>

<p>&#8220;bla blah blah&#8221; is not sexual discrimination. The playfully touching part could be. Tell him you don&#8217;t appreciate his comments, especially the touching, and he&#8217;s to stop it immediately. If it continues, report him to HR. You really should keep a record of all this. <p>does the job still pay you if you get laid off? because your technically not fired so</p>
<p><strong>Answer:</strong></p>
<p>To collect unemployment, one must be ready, willing, and able to go back to work. One must also apply for UE benefits because it doesn&#8217;t just come to you. He had to be working within a certain time frame. UE goes back several months to see when and where he worked and how much he got paid. If he qualifies, he will not collect full pay. It&#8217;s a small percentage based upon his previous wages.</p>
<p>As far as getting kicked out of the recovery house, that would depend upon house rules. He needs to find out.</p>

<p>I get asked a lot &#8220;How does it feel to be trans&#8221;? and I often find myself not sure how to answer that question. I mean in order to be able to relate, there has to be a common ground of reference you know? Like trying to explain what coming back from death would feel like to someone who&#8217;s never gone through it. We&#8217;ll never know unless we walk in those shoes. So..I usually try to answer it by asking the other person &#8220;In order for me to try to explain it, it would be best if I asked you, are you aware of the privileges you have in society by NOT being trans?&#8221; And people often ask me, &#8220;What do you mean?&#8221; So I found this list of &#8220;cisgender (or non transgender) privileges&#8221; spoken from the perspective of the non-trans person. In reading them, think about these privileges and how trans people do not have the same opportunities and societal &#8220;givens&#8221;. This is also why I call b.s. when some glb people try to tell me &#8220;we&#8217;re all in this together, I understand, we all have discrimination&#8221;. NO. Sorry, but what you experience is nothing anywhere CLOSE to what I experience on a nearly everyday basis. See below at all the privileges you have, that we don&#8217;t.</p>
<p>1) Strangers don&#8217;t assume they can ask me what my genitals look like and how I have sex.</p>
<p>2) My validity as a man/woman/human is not based upon how much surgery I&#8221;ve had or how well I &#8220;pass&#8221; as a non-trans person.</p>
<p>3) When initiating sex with someone, I do not have to worry that they won&#8217;t be able to deal with my parts or that having sex with me will cause my partner to question his or her own sexual orientation.</p>
<p>4) I am not excluded from events which are either explicitly or de facto men-born-men or women-born-women only.</p>
<p>5) My politics are not questioned based on the choices I make with regard to my body.</p>
<p>6) I don&#8217;t have to hear &#8220;so have you had THE surgery?&#8221; or &#8220;oh, so you&#8217;re REALLY [insert incorrect sex or gender]?&#8221; each time I come out to someone.</p>
<p>7) I am not expected to constantly defend my medical decisions.</p>
<p> <img src='http://work-laws-exposed.com/blog/wp-includes/images/smilies/icon_cool.gif' alt='8)' class='wp-smiley' /> Strangers do not ask me what my &#8220;real name&#8221; [birth name] is and then assume they have the right to call me by that name.</p>
<p>9) People do not disrespect me by using incorrect pronouns even after they&#8217;ve been corrected.</p>
<p>10) I do not have to worry that someone wants to be my friend or have sex with me in order to prove his or her &#8220;hipness&#8221;, &#8220;open mindedness&#8221; or &#8220;being P.C.&#8221;</p>
<p>11) I do not have to worry about whether I will be able to find a bathroom to use or whether I will be safe changing in a locker room.</p>
<p>12) When engaging in political action, I do not have to worry about the gendered repercussions of being arrested (i.e. what will happen if the cops find out that my genitals do not match my gendered appearance?) Will I end up in a cell of my own gender?)</p>
<p>13) I do not have to defend my right to be a part of &#8220;queer&#8221;, and gays and lesbians will not try to exclude me from our movement in order to gain political legitimacy for themselves.</p>
<p>14) My experience of gender (or gendered spaces) is not viewed as &#8220;baggage&#8221; by others of the gender in which I live.</p>
<p>15) I do not have to choose between either invisibility (&#8220;passing&#8221; or &#8220;going stealth&#8221;) or being consistently &#8220;othered&#8221; and /or tokenized based on my gender.<br />
16) I am not told that my sexual orientation and gender identity are mutually exclusive.</p>
<p>17) When I go to the gym or pool, I can use showers.</p>
<p>18) If I end up in the emergency room, I do not have to worry that my gender will keep me from receiving appropriate medical care, nor will all of my issues be seen as a product of my gender. (&#8220;Your nose is running and your throat hurts? Must be due to the hormones!&#8221;)</p>
<p>19) My health insurance provider (or public health system) does not specifically include me from receiving benefits or treatments available to others because of my gender.</p>
<p>20) When I express my internal identities in my daily life, I am not considered &#8220;mentally ill&#8221; by the medical establishment.</p>
<p>21) I am not required to undergo extensive psychological evaluation in order to receive basic medical care.</p>
<p>22) The medical establishment does not serve as a &#8220;gatekeeper&#8221; which disallows self-determination of what happens to my body.</p>
<p>23) People do not use me as a scapegoat for their own unresolved gender issues.</p>
<p><strong>Answer:</strong></p>
<p>My question wouldn&#8217;t be &#8220;what&#8217;s it like&#8221;, but rather why are you transgendered? There are two genders, male and female. When a mutation of the two results in a third, ya gotta ask what went wrong? If you&#8217;re doing it because you made a lifestyle choice to do so, then you have no protected rights so don&#8217;t act like you have something coming to you that doesn&#8217;t exist. If you&#8217;re doing it because of a genetic condition that went haywire, then you may be protected under disability laws.</p>
<p>Are you having any employment related issues because of it?</p>

<p>Noted black economist Walter Williams argues that discrimination should be allowed; that freedom of association necessarily involves being discriminating in one&#8217;s selection.</p>
<p>He points out that people practice careful discrimination in choosing friends and spouses&#8230;and that marriage has much more of an impact, economically, on racial groups (because people generally pick mates of their own race based on the same affinity that the government has outlawed in hiring) than any hiring or contracting process.</p>
<p>If you choose to marry person A instead of person B, person B may experience loss while person A enjoys advantages.</p>
<p>The point being, that if the government continues its trend/efforts to eliminate &#8220;discrimination&#8221;&#8211;that is, free choice&#8211;in all aspects of society with EEOC lawyers and affirmative action and so on, then soon it will be forcing people to marry someone outside their race in order to promote &#8220;equal opportunity&#8221; and quotas, etc.</p>
<p>Williams is careful to point out that it is in fact marriage which impacts the economic status of blacks far more than any employment situation, as it is matrimony which ensures that whites sustain wealth within their cultural milieu.</p>
<p>Williams does not see this as wrong&#8211;he is a conservative, and recognizes that the government&#8217;s role should not be to interfere in freedom of association, nor to attempt to force/guarantee equality of outcomes for those who possess and/or lack certain characteristics.</p>
<p><strong>Answer:</strong></p>
<p>Personal relationships are nothing like employment relationships. There is no &#8220;equal opportunity&#8221; in a personal relationship. Discrimination in the workplace prevents a person from making a living. Discrimination in personal relationships prevents one from getting laid. Big difference. Williams is a moron for attempting to equate an apple to an orange. And yes, I would expect that coming from a conservative.</p>

<p>Hi, I saw an ad for a job, where one of the requirements is that you be a non-smoker. The job is not at all physical (it&#8217;s a desk job), and the employer states that he simply doesn&#8217;t like the smell of smoke. Is it discrimination? <p>PS &#8211; I&#8217;m not a smoker, but I feel it&#8217;s a personal choice. I&#8217;ve known great people who are smokers, and I don&#8217;t think it effects one&#8217;s ability to work. Also, the smell is bad, but that&#8217;s what lotions and fragrances are for. So please don&#8217;t ride me to tell me to quit smoking, because that&#8217;s one habit I never started! I&#8217;m more of a nail biter. <img src='http://work-laws-exposed.com/blog/wp-includes/images/smilies/icon_wink.gif' alt=';-)' class='wp-smiley' /> </p>
<p><strong>Answer:</strong></p>
<p>It is discriminatory towards smokers, but it&#8217;s not the illegal kind of discrimination. Smokers are not in a protected class.</p>
<p>On the other hand, if the Caucasians were allowed to smoke, but the African Americans couldn&#8217;t, that would be racial discrimination, but still, not &#8220;smoking discrimination&#8221;.</p>

<p>i called a lawyer about a pregnancy discrimination case with my job. the lawyer told me he thinks i have a good case and he made me an appointment. what can i expect when i go talk to him? ive already told him my situation on the phone and im just wondering what the steps are. by the way its a big company that im trying to get a lawsuit against. if anyone has any advice or have had an experience with a lawyer i would really appreciate it.</p>

<p>Alright, I know this is an old, obvious question asked by hundreds of people, but please read all of this before you jump in and say, &#8220;JUST CUT IT!&#8221; or something of that nature. I know, &#8220;Yes, it&#8217;s legal for them to fire you for your hair length.&#8221; But, my question is, how do people not see this as discrimination? It so blatantly IS. A woman can have her hair short, shaved, long, straight, curled, stripped, up, down, anyway she wants it, but a man can only have a short, &#8220;clean cut&#8221; hair style. That is an obvious example of discrimination. Some have told me, &#8220;No, because in some jobs, you have to wear a tie and girls don&#8217;t. Is that discrimination?&#8221; No, it&#8217;s not. Ties are CLOTHING, items you can put on and take off your body when you leave the workplace. My hair won&#8217;t grow back when I walk out the door. &#8220;Your hair grows back!&#8221; Yes, but I&#8217;m saying I&#8217;m not being allowed to grow it back if I have the job. Though I don&#8217;t really like &#8220;dress codes&#8221;, I don&#8217;t argue about them because I can change when I get off work. But hair should not be a part of the dress code. Hair is on your BODY. Clothing should only matter. That&#8217;s why it&#8217;s called a DRESS code. Anyway, I wanted to make a few valid points for some of the obvious things I can imagine people telling me. My question though, is, for those of you who thinks it&#8217;s not discriminatory to force a man to cut his hair off for a job, but allows a woman of the same job to have any hair she wishes? I don&#8217;t want to hear a bunch of nonsense like, &#8220;Don&#8217;t you know how hard jobs are to find?!?!? Just cut your hair!&#8221; I&#8217;m not here for that, I&#8217;m asking a simple question about the definition of discrimination. Thank you.</p>

<p>Sounds like a Republican boss who refuses to get with the program. It&#8217;s old school. I don&#8217;t think long hair should matter if it is clean. Is it discriminatory? Yes. Is it illegal discrimination? Not unless there is a religous requirement to have long hair. Wonder what they would think if you wrapped you hair up under a short-styled wig. LOL</p>
