I am a waitress for a non-corporate chinese restaurant in Anderson, South Caroina. I am currently 5 1/2 months pregnant. I complete all of my job duties properly and never complain about any physical labor. My boss recentley has been cutting my hours down to 3 shifts per week. I usually work at least five. She refuses to be confronted when I try to talk to her about it and will walk away from me and go to her office. Can I report her for discriminating against me because I am pregnant? I'm an excellent worker and have no complaints, so there appears to be no other reason for my hours to be cut.

Workers comp is NEVER EVER pre-approved.

Go get the Xray. Ask them to bill the insurance company.

Heaven forbid, if it comes up something like a tumor in your spine (clearly not work related), then you ahve to either pay out of pocket, or put it under your health insurance.

How can they know for sure, it's work related, until AFTER the xray? They can't. So they don't pre-approve.

If your company still hasn't heard from the work comp carrier than I suggest that you have your doctor file it on your behalf. I would seek treatment and get your check up for your back and than bill the insurance company once your claim starts. Each time you wait and wait it looks shady and shady as it goes. Questions like, was he playing sports when the injury occurred.

So see the doctor, ask them to file the claim on your behalf.

@April, a leave of absence is not the same time off with a pregnancy. Pregnancy is treated as a short-term disability and disability laws apply.

In order for you to go on a loa and keep ur job is to be there for a yr then they can only keep ur position for 12 weeks. If you have short term or ond term disability on ur insurance they have to hold ur job for a yr but u loose ur position and ha e to take what is availble. If u have only been there less then a yr then ur

Worker's compensation would be definitely the way to go. It sounds like your bosses do not take this situation very seriously. Too bad. It is going to cost them in a long run!

My husband and I are having a lot of problems at work and one major problem is that i was on a family medical leave and my hr went in to my husbands personal file, got his mothers adress and sent me a certifed letter. the problem is that he never gave them permission to go in to his file for other reasons, not for him. my adress is current in my file and I dont feel safe even updating my phone number now because I think and know they will give it to other people.

@Charles, getting laid off when you're a good worker makes it all that much harder for both parties. However, you can be let go for any reason so long as it's not an illegal reason.
