A Guide To Completing Your Age Discrimination Lawsuit

With so many companies now preferring a younger, more recently qualified work force, many individuals are filing age discrimination lawsuits. This article is intended to equip you with the information you need about age discrimination and how to file an Age Discrimination Lawsuit.

The majority of age discrimination is when older workers find themselves prejudiced against in the work place. This is entirely due to their age. In a small amount of cases the reverse may be true where younger workers are discriminated against.

One would ask the question why one is suddenly experiencing age discrimination in the workplace when age was no issue when the person was hired. The reason for this is that with transfers, new additions to the staff and other similar factors, the dynamics of the work force change and new members of the staff have more pull in the decisions that take place.

The American Age Discrimination Employment Act ( ADEA) enforces that older members of staff are judged and rated on their ability to produce work and not on their age. Despite this discrimination still exists and this when companies are taken to court for age related discrimination .

Younger people have degrees and are though to be more of an asset to the company. Surely you cannot beat hands on experience? Text books do not show you how to do the work, they simply give you a whole pile of theory.

1967 was the year when age discrimination first came about. For this reason the ADEA came about. The fundamental purpose of the ADEA is to ensure that people are employed on their ability to perform work related tasks and not on how old they are.

Age 40 and over people are also protected. They cannot receive lower increases, have less company perks and benefits, or get their salary chopped on the basis of their age.

No one can be made to retire early on the basis of their age. They can volunteer for early retirement only by their own choice.

Naturally in certain occupation types people cannot be employed or in the employ of a company. Examples of this would be emergency rescue services, fire fighters and members of the police force. You could not expect an 65 year old to chase down a young criminal on foot. Should the occasion arise where force is necessary this could also be a problem.

In the case where a younger person is obviously better for the job then the company must show that everyone above that age group would be unsuitable for the job.

If the job concerned requires the services of a younger person it must be proven that all people over a certain age would not be able to perform the tasks concerned with that specific job spec.

These are some, but not all of the considerations when researching how to file an age discrimination lawsuit.
