After Pregnancy Discrimination
I work in California. In September last year i delivered a premature baby and 4 months after he passed away in the NICU. I took 2 months when I had him and 3 weeks when he passed away. I am a very hard working women, I’m always on time, I perform my job really well and never get into trouble with anyone. I’ve been working for almost 2 years.
I overheard my boss saying that I’m not going to take a promotion because I been away from work a lot, because I took time away a lot. Nothing about my performance just because i took time away. Is this discrimination?
My boss is a guy and in fact that was my maternity leave and actually I didn’t take my extra 6 weeks maternity leave by the state, because i knew they needed me at work.

Were you up for promotion? Was it already discussed with you that you would get one?
If you overheard your boss saying it to someone else, but he never said it to you, then you haven’t been denied anything. He’s just talking smack. Until he officially denies you the promotion, you haven’t been denied anything.

Oh my God, you poor woman
I gave birth to a premature baby & he had to spend time in NICU. It’s a nightmare situation…then you had to deal with the untimely passing of your precious child. To then be slapped in the face by your workplace treating you poorly for having the audacity to take time away from work to deal with your dying child…what monsters! I am not an expert on the legalities, but yes, personally, I would call that discrimination. And worse yet, inhumane. What a monster to say something like that about you. What you went through…no person should EVER have to go through. My thoughts and prayers are with you.
First and foremost, I am so, so sorry about your loss!
And second, yes, this is discrimination. I don’t think it is the type of situation where you can take legal action for damages, but I believe it would be worth speaking with an attorney about. An attorney would be able to give you the best advice about how to handle this situation.
