Can he sue for racial discrimination?
Question by Krista:
My fiancè was at work when his supervisor couldn’t find him he told her where he was and he asked why she always ontop the black people and she said “niggers don’t do work” can he sue for discrimination? There was also two witnesses and if he can sue how do we go about this.
Best answer:
Yes, it’s discrimination, but an isolated incident of name calling isn’t severe enough to sue. However, if she consistently does it and he documents it, names witnesses and all, then he can file a claim. Click here to find out how to document problems at work.
It is unlawful to harass a person because of that person’s race or color.
Harassment can include, for example, racial slurs, offensive or derogatory remarks about a person’s race or color, or the display of racially-offensive symbols. Although the law dosen’t prohibit simple teasing, offhand comments, or isolated incidents that are not very serious, harassment is illegal when it is so frequent or severe that it creates a hostile or offensive work environment or when it results in an adverse employment decision (such as the victim being fired or demoted).
The harasser can be the victim’s supervisor, a supervisor in another area, a co-worker, or someone who is not an employee of the employer, such as a client or customer. http://www.eeoc.gov/laws/types/race_color.cfm
