Discrimination at Work Because I’m a Minority

 
 

 

I work in sales and have been since July of 08. I took about 7 months off last year after giving birth to twins and returns to work in late July of 09. I work 30-35 hours a week which is part time. However, I am the only employee that isn’t on payroll as part time. I am on as seasonal. I’ve asked my manager 4 times to switch me and she says, “oh, yeah. I need to do that.” She never does. There is another girl that starts working there in December and she had our paper work and the same time and switched her to part time but not me. This girl works less hours than I do. I can’t get any health insurance or as good a discount being seasonal. Another girl, M, ONLY works season (Christmas, valentine’s,etc) but she has part time status. I am the ONLY minority. I am also the only that no one shares with. Everyone shares sales, credit apps, service plans, to help eveyrone’s standards. NO ONE helps me. I don’t have problems with anyone at work. I sold 39k more last year than i was goaled and my standards are the best. AM i wrong or is this pure discrimination?

Answer:  Race/Color Discrimination & Work Situations:  The law forbids discrimination when it comes to any aspect of employment, including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment.  Document it.  Write it all down and then hand it in to HR.  Do you have an employee manual?  Get it out and look for things your boss is violating.  Click here to learn how to document problems at work.

    It could be discrimination, or you could just have a truly lazy supervisor. You might try talking to HR about the fact that you are not seasonal and the fact that the status is affecting your ability to get insurance. That is really the important point here. If your status is prohibiting you from getting benefits that you otherwise would, they need to adjust it. But you need to approach it carefully, without the discrimination card first. For a discrimination case, you have to be able to prove that their motivation is strictly racial. In this case, although you seem to have some good points, it sounds doubtful to me that is the case.

    Go to HR and talk to them calmly about the situation. Or, if you feel it will help, first go to your supervisor one last time and THEN get HR involved.
