Do I have an age discrimination lawsuit against my employer?

I have worked at a corporation for 20 years. They changed my station to the back so they could put a young person there. The co. wants the public to see younger people working there.

That is not necessarily true. Because they changed your station and a younger person works up front, doesn’t mean they are discriminating against you. I have worked at several jobs and my desk moved often. You would have a hard time finding an discrimination attorney that would be willing to take this type of case.

  • If you’re at least 40 and the straight up said they wanted younger workers to be seen, hell yes, it’s age discrimination.

An employment policy or practice that applies to everyone, regardless of age, can be illegal if it has a negative impact on applicants or employees age 40 or older and is not based on a reasonable factor other than age. Read more about age discrimination here…

In order to have a successful lawsuit, you must have been harmed/damaged. When they moved your work station, did they cut your salary. If not, how have you been harmed by this? Also, depending on the business, they may have a legitimate interest in ensuring that their "public face" projects a certain image. For example, if it was a youth clothing store, teenagers probably wouldn’t want to buy clothes if it looked as if their parents were working the register.

yup, thats age discrimination, as for if you win, depends on the size of the company, they just want to lure more workers
