Do you still get paid if you’re injured at work at can’t work?

Question:

If you where injured at work, do you still get paid, even if your not working cause of the injury?

Answer:

It depends upon how long you’re off work. If you filed a Workers’ Comp claim, lost wages are paid out at a percentage of your regular pay. You don’t get full pay.

  • P.C. says:

First thing you should do if you were injured at work is file a workers compensation claim. Depending on what state you’re in your employer should have coverage through an insurance company, a state program, or they just take a huge risk and insure themselves. If you are unable to work, you should be eligible for disability. Check with your employer to see if they have a group disability policy. If not, your state will offer something. There is a sort of grace period though for collecting disability. Sometimes it is as little as 14 or as much as 60 days before they will pay you. Once disability kicks in, they will go back and pay you from day 1. Don’t expect to receive your full paycheck. Disability normals pays about 2/3 of what you were making up to a certain dollar amount. That figure varies by state and even region too.

Next, check with your employer, some employers offer a "return to work program" where if you were injured on the job, and are partially disabled or are recovering from injuries, they will put you to work performing other lighter duties.

Last, if you were injured due to your employer’s negligence, I would contact an attorney and see what your rights are. You may qualify for further compensation.

    Hope this helps. Good luck!
