Hello,

I just received this email from my ex employer’s attorney. He knows I have received harrasment from my old employer. Also they have comitted unemployment insurance fraud. I have unpaid over time and regular time wages unpaid. They are in many violations no labor laws posted, gay jokes, racial jokes, etc… I really am in need of representation or some help responding to the email below from their attorney. If you read the email it is quite obvious that the attorney know’s I have a case. What should I do??? Please help??? I really just want to received unemployment that I am entitled to. The employer fired me with no reason and now is saying I quit. Then they tried hiring me back on to have a 1 year review and fire me again. I of course didn’t go and have enough evidence to prove I am entitled to unemployment. Please read below….I NEED HELP!!!

I still haven’t heard from your legal representative, so I am contacting you directly.

My client has forwarded your EDD paperwork to me. As you know, you are not eligible for Unemployment Insurance benefits if you were terminated for cause, quit, or have another job – even if the other job is through self-employment. Nevertheless, if we can resolve all of the issues arising out of your separation of employment, Bill and Tara are willing to accept your representations that you are entitled to benefits and not oppose your application. Non-opposition would be in addition to their offer to pay you an additional week’s salary and allow your medical insurance to continue through July.

This offer is contingent on your waiver of all claims arising out of your employment with Tara and Bill. Because of the time limits in responding to the EDD notice, the offer will remain open only until Monday, July 13. If I have not heard from you or your attorney by then, the offer (including salary and benefits) will be off the table.

  • They cannot withhold any unpaid wages or accrued vacation/paid time off. They also have to pay you within 72 hrs of letting you go. They are basically stating that if you don’t sue them, they’ll give you an extra week’s pay and extend your health insurance.

    Your employer can fire you for no reason at all, even if it’s an unfair or bad reason. It just can’t be an illegal reason.
