Ethnic Discrimination At Work
My boss said a few things to our team and HR said it was unethical.
My boss outsourced some people from her country to help us during our off hours. I am a U.S. citizen and we are in a company in USA.
1) She said, “We can replace you with 10 people from my country to work cheaper and better.”
2) “You are overpaid. People in my country doing the same thing as you make less than 1/3 of your salary and benefits.” She said that to me and the whole team countless times.
3) “It seems like this proves that people from my country are smarter than you.” When we can’t meet a due date.
4) “People from my country are smarter, more hardworking, are better educated and get less pay than the American workers.”
4) “Since your vacation hours are too much, report your vacation days this week, however use it next month.”
Is that kind of talk racism/discrimination? HR asked me to sign something if they let me go or fire me in the future to not sue the company.

Your boss is straight up guilty of racial/ethnic discrimination because she’s threatening your position. She’s creating a hostile environment.
Harassment
Harassment on the basis of race and/or color violates Title VII. Ethnic slurs, racial “jokes,” offensive or derogatory comments, or other verbal or physical conduct based on an individual’s race/color constitutes unlawful harassment if the conduct creates an intimidating, hostile, or offensive working environment, or interferes with the individual’s work performance.
Compensation and Other Employment Terms, Conditions, and Privileges
Title VII prohibits discrimination in compensation and other terms, conditions, and privileges of employment. Thus, race or color discrimination may not be the basis for differences in pay or benefits, work assignments, performance evaluations, training, discipline or discharge, or any other area of employment.

Do you have an employee manual? What does it say about your vacation time? When she says you have too much vacation time and you have to use it, where in the manual does it spell that out, or is she making up crap as she goes along? She cannot violate company policy.
