Fired From Work Without Reason, How Can I Get Unemployment?

 
 

 

I worked at a thrift store for six months and I was fired for no reason. They did not tell me why and I did not ask. I was given no offical paperwork to sign. I’m trying to get unemployment and the the owner of the thrift store won’t return my calls.

  • They can fire you without reason so long as it’s not an illegal reason. Only the state of Montana requires a reason. The only other exception is if you have a contract.

    The unemployment office will need a reason. Provided you qualify for benefits, the UE office will send a notice to your former employer and they will need to list the reason. If it’s a reason that prevents you from receiving benefits, you can request a phone hearing.

    Most states are at-will employment states which mean you can be dismissed from a job with or without cause and you can leave any position with or without cause or notice, with the exception of jobs under contract. It is okay that you didn’t’ get a reason and since you want to file for unemployment you are better off without a reason. Since you were let go, unless it was for gross misconduct (and if that were the case they would have to have told you that), you are practically guaranteed unemployment. Just tell the unemployment office that you don’t know why you were let go and it was probably a lay off. Your former employer will have a chance to rebuttal and if they don’t, you get the unemployment and if they do, you’ll have your reason and a chance to rebuttal that. Good luck.
