Fired from work, wrongful termination? Should I speak to a lawyer?

 
 

 

I was fired recently from a well known retail store, more so for their infamous tendencies of treating workers unfairly.

Main points of my story:
Had an injury at work not 2 weeks before they fired me

They fired me for a product left out past its time it should have been removed from the sales floor. I indeed checked the product but it still had 30 mins left, I then put it in front of another associate to remove when it was up and went on my over due break. I’ve never had an issue with pulling a product when it was time before, shouldn’t they have given me a verbal warning prior to terminating me?

Was it still my fault even tho I was on my break? Why was there no action taken with the other associate who was standing right in front of it the entire time? Can I claim sexism (because he was a man, they always seem to favor them at my job) Also they wouldn’t show me the pictures of the video when I asked for them.

Any advice on the issue would be very much appreciated.

    When they fired you, was it for insubordination? According to your facts, they told you to remove an item that was past it’s time. You checked, saw that there was 30 minutes left, so you ignored their request and then pass it to another associate to remove it and went on your overdue break.

    The reason for the removal most likely would be that a customer would not buy it. By your thinking there was 30 minutes left, but if a customer bought it, by the time they took home, would be past its time.

    You failed to follow instructions. They told you, not the other associate to remove the item. My guess is that this is not the 1st time you took it upon yourself to do what you wanted to do or felt was right and this last episode was the final straw.

    As for the injury and video, no facts are given to figure how this has anything to do with your termination.
