FMLA Retailiation At Work

 
 

 

I have an medical issue which is interfering with my job. I told them at work and they insisted i get a doctors note and sign FMLA paperwork which I did and am out of work now on the leave. Now they are telling me to ask doctor if I should get another job. They have been telling me since new management took over I am under performing and they want to change my job some to help me. Not sure if they are trying to get rid of me or are genuine. any ideas?

    The doctor signed it and that’s all your employer needs. “Get another job”? Why, so they don’t have to pay for your health insurance benefits while you’re out on FMLA? “…change my job some to help me”? Bullshit. They want to help themselves.

    While you don’t get paid when you’re out on FMLA, your employer must continue to pay for your health insurance. That’ pisses them off.

    Also, you do not have to take all 12 weeks of FMLA all at once. If your condition allows you to work reduced hours, your doctor can write a note to that effect, say come in a little late or leave a little early and your boss can’t say a darn thing about it.

    It’s FMLA retaliation and you can file a complaint with the US Department of Labor. And if you run out of federal FMLA, check if your state has a medial leave program so you can continue to take off some more. What about disability? At least then you’ll get paid.
