Got Fired Even With Doctor’s Notes

 
 

 

i was terminated from my job because of attendance. but 98% of me absences were accompanied with doctors notes excusing me from work is this legal and where can i find documentation that it is illegal so i can take it to my unemployment hearing.  This is in New York.

    I get you iam in the same situation , i have all my doctors notes, i have fibromayglia, and I get sick often my boss wrote me up 6 times for my absences , but whenever i am out i bring in the doctors note, i even let her know about this diease. i have she say she dont care. and when i asked for a medical leave she say she wont approve it, my head of my union know ALL OF THIS AND I SAVE ALL MY DOCTORS NOTES

    So my question is I was in the hospital this past Tuesday morning I went in about 3a.m and was still in there until almost 11 a.m. I knew that I was going to be in there for a while so i called my boss at 730a.m way before my shift at 1245 to tell her I was in the er. I then called her right after I was released around 11 and told her that i was given a doctors note and that I couldnt come in i had a 4 hour shift and the next day was my day off and I was going to go in the next day i was schedualed to work which was Thursday. She told me if i didnt go to work that day that she was going to replace me regardless of the doctors note. Even though she had told me that on Thursday I went into work at my schedualed time and she told me that I would not be working there any more and to get my stuff and leave. I did as she asked and still gave her the doctors not. I feel like i was wrongly let go because i have only missed work about 6 months ago and it was only because I was in the hospital. If i was wrongly fired what do I do to make it right?

  • You can get fired for any reason so long as it’s not an illegal reason, even if it’s “not fair”. Do you have an employee handbook? What does the company policy state about attendance? Did you violate it? If not, did the company not follow its own policy when it fired you? If THEY violated their own attendance policy, you might still be able to collect unemployment. You’ll have to have proof when you go to your UE meeting or phone conference.
