Got Injured At Work, Worker’s Comp Doesn’t Want To Pay

 
 

 

I got injured at work. I went to see the company doctors and they said i don’t have a permanent disability. so i choose i different doctor and this doctor says i do. I’m in alot of pain and stuck working while my attorny fights for worker comp to pay for my doctors visit.  but i can hardly work and i need to get paid what can i do?

    the first answer to your question is a bunch of bull, get a good workers comp /personal injury lawyer , the insurance will do everything they can to not pay anything , i’ve been fighting my first case for 4 1/2 years now. most insurance companies will keep draging it out in court till you give up, DON’T QUIT FIGHTING THEM thats what they want . good luck , like I said it takes alot of time , and effort on your part.

    First of all I hope you file an injury report with your boss and you have a copy of it including names of witnesses. Witnesses can always be court order to testify regarding the injury weather they want or not (this is your lawyer’s job to do) The report and witnesses along with all doctor’s visits, treatments, meds etc… will benefit you in building your case. Second, ask your doctor to give you a note requesting light work for right now. If doctor is uncooperative you can go to any other doctor to get what you want, keep excellent notes, with names and everything (journal very handy for legal matters). Third, relax and do not pay any bills, if proven which you are indicating that it is workman’s comp injury ALL the bills will be paid 100% by you company’s special insurance that they have for workman’s compensation. Usually the company takes its sweet time in paying bills and they tend to find a way to harrass employees that have a pending case against them. Journal is important, copy all documents you submitt and always be on time (business as usual).

    As far as the company’s doctor do not despair he is with the company and his job is to protect the company’s interests (bias). This is why you have the right to see other doctors and always seek a 2nd or 3rd opinion if needed.

    My advice is that you need to work very close with your doctor and attorney in order to prove your case. Follow all their recommendations for the purpose of your disability if such.

    All those bill collectors ignore them or flatly tell them that you have a workman’s comp claim pending. Your company have the legal obligation of paying all bills at 100%.
