High Performance Reviews Turn Into Sexual Discrimination
I was wondering if anyone has had experience with sexual discrimination at work, if they filed a complaint about it and what happened? I was fired from my job a few months ago, reason being poor work performance. however a month before i was fired i had my one year review and recieved all 4′s and 5′s ( 5 being the highest) plus my raise and my supervisor told me i was doing a wonderful job. then a few weeks go by and a male co-worker verbally assaulted me in front of everyone in my work area. i walked away from him and my supervisor asked me about the incedent the next day. i told him what happened and he said he would look into it. a couple days later he told me the male co-worker had the right to file a inhouse complaint against me for something i did to him. (which was proven i didn’t do) when i asked if i had the same right, my supervisor told me that i didn’t because i started the whole situation. a couple of days after that i was fired from my job for my poor job performance. never had any warnings about my job performance and was told i was doing good. i filed a complaint with human rights commision, but i was just wondering what other’s thought or if they have similar experiences.
i figure sexual discrimination because my male co-worker was given the right to file a complaint against me (me being female) and i was not given the same right. when the men are found to have poor work performance they are given warnings first. this male co-worker had some of his property moved at work, moved by another male co-worker, i was the one blamed for it, although it was later proven that it was the other male co-worker who moved it. i was the one who got in trouble for it.
yeah. i am collecting unemployment. and the human rights commision said they see the complaint as sexual discrimination so that is what i filed for. and now i am finding when i fill out an application for a job the only ones who call me for an interview are the ones that i don’t put down my last employer (company that fired me for “work performance”) can’t prove anything there, but it seems a little fishy.
I don’t see sexual discrimination. It’s more like gender discrimination. And the good performance suddenly gone bad without any prior problems or documented problems is a clear sign of retaliation. I had it done to me, but didn’t know what to do about it. It wasn’t until after I got laid off that I found and downloaded Work Laws Exposed and it explained it all and what I could have done about it. Only thing is, signing for the severance package screwed me because I agreed not to sue.

Sounds like what they did was retaliation. My suggestion to you is to request your entire personnel file (you are entitled to it regardless of what they company says) and go to the EEOC. Let them know the issue and they will in turn investigate the issue and if there is suspected violation they will issue you a right to sue letter that you can take to a lawyer and sue the company.
