How To Deal With Harassment and Discrimination At Work

 
 

 

Every single day, all day at work I hear jokes about black this, black that. “I like fried chicken because I’m black”. “I like watermelon because I’m black”. I happen to like neither. Every single day my job is stressful because I am constantly being degraded by such ignorant people. I’ve confronted the people who are spewing such ignorance with no success. They just don’t get it. I’ve explained to them how it makes me feel and even given them some analogies so that they can empathize but they are so ignorant that everything is a joke to them. They even make fun of white and Mexican people. It’s 2:30 pm right now and I should be heading to work but I’m so stressed right now that I have a headache because I know that working means being subjected to guaranteed and constant harassment. I could stoop to their level and return insults or knock them out and go to jail but that would just support a bunch of negative stereotypes. Trust me, I could knock them out because I’m no wimp. I just want to do the right thing. Jail sucks anyway. The manager can’t do anything anyway but give them a stern talking to. These people are so content with what they do, they’ll just keep on doing it anyway because they don’t see it as being wrong at all. Even one of the assistant managers called me a monkey and threw her head back because she laughed so hard.

So…again, what am I to do when I have to go to a crappy job for crappy pay and work with people with crappy attitudes in a crappy town? I would quit if I could get another job in this town but I can’t because I tried and my car isn’t working right now and I need money. Any legal advice would be appreciated.

  • Holy crap! I’ve said it before and I’ll say it again, people suck. I would nip that in the bud right now by documenting it. Gather up all the mean things people are doing and go straight to HR and your boss with it. Quote what was said, who said it, the date, everything. Here is a free download that will teach you how to document problems at work. It’s called “10 Things That Managers Do To Get Sued…And Lose In Court”. It also works on co-workers like yours. HR or your boss MUST put a stop to it. If they blow you off, then go straight to the EEOC and file a claim. http://www.eeoc.gov/employees/howtofile.cfm If they don’t sue on your behalf, they will issue a right to sue letter, at which point you can find an employment law attorney.

    These employees are creating a hostile work environment which is an actionable tort under employment law in all fifty states since it’s a federal law.

    Talk to your manager, mentioning that these employees are violating federal law that could get the company in trouble. If he still does nothing, you can go to his boss or HR (preferably HR).

    Once you’ve notified at least two people in charge at the company and nothing is done then you can go to the fed and get them in real trouble as well as maybe get a lawsuit going.

    Seriously.
