Husband Got Fired From Work, They Wouldn’t Give A Reason
Okay, so my husband has been working for this NY style pizza place for a little over 2 years and has been a VERY loyal emplyee. The bosses would call him up on his day off (yes, 1 DAY off) and ask him to work open to close (9 am – 11 pm) shifts and he’d do so without hesitation. Whenever they need someone to cover shifts, they ALWAYS call him first and he always accepts. He always goes in to work on time if not early. They had him on a open to close schedule but didn’t want him getting any overtime hours so they’d send him to the other restaurants that they have in different locations which, btw, are about and hour and a half away from where we live :/ those cheap a**holes.. Anyway, He went in to work today early as usual, started doing some prep and the manager came up to him AFTER he was done doing all the prep and said ‘Hey, I just spoke to Carlos ( another manager ) and we’ve decided that we won’t be needing you anymore” when he asked why he was being fired, she simply said “I don’t have to explain myself to you”. Is that acceptable???? Are employers allowed to just fire you without any reason at all? Is there any way that I can file a complaint against them? and to who? We live in the state of North Carolina.

It sounds to me like he was laid off, not fired, because they said “..we won’t be needing you anymore”, they didn’t say we’re firing you.
If your husband files for unemployment, he needs to say he was laid off, not fired. If he said he was fired, he’s going to have a battle on his hands. Was he fired for cause or through no fault of his own? He’ll have to request a hearing to get to the truth of it. It’s best to say he was laid off. Then a notice goes to the employer and they either agree or disagree. Just let it play out. If they agree, then fine. If they disagree, then request a hearing.
You can try the Department of Labor, if they were screwing him on overtime and he has proof of his hours worked, then you can get them for back pay. The other suggestion would be to find out who the actual owners of the restaurants are and have him speak with them directly to let them know how he feels about the way he was treated.
Sorry, but most of the US does not require the employer to provide any explanation as to why they are terminating an employee. However, if they now turn around and try to hire for the same position, the NC state labor department might find the situation ‘interesting’ since they did not terminate your husband for any explained fault.
