I need help w/ retaliation in the workplace
A Reader Asks This Question:
I recently filed a claim w/ the district attorneys office b/c i was having to punch out for a break while continuing to work (i work at a hotel 3-11, where I’m at the hotel alone). corporate got in trouble and got upset with me. After all this i was supposed to get a 1.00 raise as promised 3 weeks ago and when I was first hired after my 90 day eval, now the hotel today tells me I’m not getting that raise. I’m planning on file a employment retaliation discrimination act for denial of promotion, before I do this I’m just curious what I’ll get out of it. will I even get my raise you think? or will this just add fuel to the fire and get my job even more upset with me?
also when they told me i would not be getting my raise they told me that they would not be offended if I quit. why would they say that?? do they want me to quit?

It’s retaliation, but it’s not discrimination. In order for it to be discrimination it would have to be related to gender, race, religion, disability, gender bias on wages, or sexual in nature.
What you did was blow the whistle on them for illegal wage activity and by them denying you the raise, that is retaliation.
What @Cicel n says about “at will employment” and being on probation, yes, they can get rid of you, but not in the manner that they’re trying to after the fact that you ratted on them. That would be illegal. Go to your state’s labor board to proceed.
And document, document, document. Write it all down. The terms of your employment, was there a contract verbal or written, who told you to work and clock out, who you reported it to, what transpired afterwards, etc.

Yes, the company wants you to quit, and if you are still within the 90 day probation period, you will probably be let go soon. In my state, the company can lay you off at any time for no reason, and you are free to quit your job as well.
