If I get laid off because of a dui/license suspension will I be able to receive unemployment?
DUI License Suspension
Question: I drive a tow truck for a living and last year I got a DUI. I have been working since then with a restricted license allowing me to work. Now my license is completely suspended and I’m expecting to be laid off soon. My question is, Will I qualify for unemployment benefits if I am laid off due to my DUI?
Answer: In order to collect unemployment, you must lose your job through no fault of your own. Since the DUI was your fault, no, you can’t get unemployment. You went from a restricted license to a full suspension? Did you dig your grave even deeper or was that just the normal progression?

So you had a restricted license that allowed you to drive. What did you do to lose that? Get arrested again? Drop a hot pee?
Now your license is completely suspended but you’re still driving a company truck while waiting to get fired (not "laid off").
You won’t have to worry about getting unemployment because you’re going to end up in jail.
But, no you do not qualify for unemployment.
You do however qualify for a nice warm seat in a 12 step meeting. I’ll buy the first coffee.
From my understanding, if one gets laid off or fired they can still apply for unemployment compensation. It is the state board that determines if the reason for dismissal is for a gross misconduct or not. Probably having a drinking while driving charge would fall under this category. Due to insurance liability issues, a company puts their business at risk if they allow a person to drive with this on their driving record.
However again it is the state that makes the decision on whether you will receive unemployment benefits, so you won’t have any chance to obtain benefits if you don’t apply.
