Injured At My New Job, But Old Work Injury Is Flaring Up

Yes I was injured at work an got on workers compensation about 10 years ago.. The place were I worked closed down like 6 years ago.. So now i have got a new job been there for 5 years but now the same injured back is hurting really bad.. can I fall back on workers compensation to pay for me to go back to the doctors.. or has to much time has past?

Answer:  “…the same injured back…”  as if you have more that one back?  Is it the same EXACT spot that’s injured or is your back injured again, as in, I had a back injury and now I have another one?

About the original injury, did the doctor say you had residual permanent impairment from the injury?  Because so much time has passed, this may be a new injury and your doctor might issue a report stating that so the claims adjuster doesn’t try to apportion it to the old injury.  Click here to get a consultation with a workers comp attorney who is highly skilled in such matters.
