Injured At Work, No Light Duty Available

 
 

 

I was injured at work & my work has told me there isn’t any “light duty” options for me (as too many people are supposedly on “light duty”) They took me off the schedule until I am cleared by my doctor to go back to work. Oh, I’m also 9 months pregnant…is this right? Is this legal?  I am a CNA.

  • Then file for Workers Compensation. You’ll at least be getting paid 75% of your wages. That’s what WC is there for.

    See a Workers Compensation lawyer. The lawyer will submit a motion in court to get you compensation. There is no up front cost to you, however you must agree to pay the lawyer a set percentage of any award you receive the normal rate is 15 to 20%

    "Light Duty" is normally offered to save the company money in Workers Comp payments. Their rate grows with each Lost Time accident. What they have done is legal, but it also means you will be able to file for compensation (through the state) once you are off work long enough.
