Is it discrimination when I am treated differently at work?

 
 

 

As an auditor I got written up for some bad parts I did not catch due to a machine operator’s mistake. In the mean time another auditor with more experience did the same thing and did not recieve a write up.

  • Here is the definition of discrimination: Under the laws enforced by EEOC, it is illegal to discriminate against someone (applicant or employee) because of that person’s race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. It is also illegal to retaliate against a person because he or she complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit. http://www.eeoc.gov/laws/practices/index.cfm

    Why didn’t the other person get written up? Did they not get caught? Did the person doing the write-up know about the other person’s error and willfully did not write them up? What does your company policy state about these write-ups? Do you have an employee handbook? Did the person doing the write-up in any way violate company policy? Company policy must be applies evenly to ALL employees otherwise it’s disparate treatment. If so, then report it to HR, but you better have proof that it happened.
