Question:

Is it still sexual harassment if a coworker is spreading sexually explicit rumors about you at your place of business? Is it grounds for a lawsuit? Is it still sexual harassment if the rumors make working more and more uncomfortable? What if the person has had other complaints against them and the company has still done nothing to rectify the problem? What should the person who feels harassed do? Site your sources please.

Police accused me of trying to catch the guy a case. They are on the side of my job because my job gives them free food (i was a waitress..i quit because the GM was pissed and I knew he was gonna make life hell for me)

How do I go about filing a complaint…then a suit. The GM at my old job doesn’t write down incident reports at all. Even after I complained about an employee threaten to jump me he still did not write anything down. I am so lost on all of this and I have no clue as to where I should even begin. I quit because I was scared of the reprecussions I might face for even bringing this up. I know the other girls got fired for complaining. I can’t go to the cops in that area because they are all on the side of my company and I honestly have no idea where to even begin with complaining and filing lawsuits. And what the hell can I do to make sure that a lawsuit sticks? I mean…a rumor is just heresay and I am worried that will not hold up in the court of law, especially since the GM did not even file an incident report when I brought it up to him.

    Not only did a hostile work environment exist and sexual harassment take place, but the firing of your co-workers due to their complaints about it is retaliation and that, too, is illegal. Go to the EEOC http://www.eeoc.gov and file a complaint. Only thing is, you’ve got 180 days from the last incident in which to do it.

    @Jim T is correct. Document, document, document. Keep a daily diary. Who, what, where, when and why. One incident is not enough. You need to establish the pattern of abuse and the proof to go with it. Accumulativly, it will hit them like a truckload of bricks.

    It sounds like sexual harassment in Australia and, from what I know, America. Your boss has allowed a hostile working environment to occur.

    You will have to prove this, so you should have kept a diary of what was happening. You cannot rely on your boss to keep records. You need to write down a history of what happened and list any witnesses that can help you.

    You also need to get advice about who you can complain to. If you are in a union, talk to them. If not contact any women’s legal advice organisation, civil liberties group etc. In Australia contact your state anti-discrimination board or organisation.

    Do this straight away. There may be time limits applying to making a complaint.

    yes it is sexual harrassment if a coworker is doing that to you, if the person who feels harrassed has gone to the top level and hit the ceiling and feels strongly about it tell management that you are going to contact the media, that would be fun to see what happens then .

    Sounds to me like you’d have a case. A hostile work environment is being created here — especially if the powers-that-be at your company aren’t doing anything about it.

    yes, that is sexual harassment! and if the company is doing nothing about it, then you need to go to a higher authority, like the police.

    If it quacks like a duck, it’s a duck. It sounds like sexual harassment to me.
