Is this discrimination with my pregnancy?
I work in a health care center. When I informed my boss that I was aprox. 6 weeks pregnant she told me that if my pregnancy was going to interfere with my work in her facility that I should look for another job. I stated then that that wasn’t her choice and she said ” oh but it is.” She proceeded to tell me that if I didn’t like the way she ran her facility then to quit. A few days ago I was in the hospital and experienced small amount of spotting. So I of course went to turn my paper in from the hospital. She then told me that ” I don’t want nothing to happen on my hands or my facility and all I can say to you is go home.” I told her that I could do my job and I had no restrictions except heavy lifting, in which its suppose to be a non lift facility anyways. I love my job and there is no reason why I should have to go home. After hearing that she told me that ” If you lose this baby it wont be my fault of the facility but I am going to say its probably for the best.” Can she do this?
Answer: NO! She cannot. Even if she thinks it’s “in your best interest for the health of your baby and yours”, she cannot do ANYTHING differently because you are pregnant.
Here is what the EEOC says about pregnancy.

No she cannot. You should document everything that has happened and continue to document events.
Flat out NO! a company can’t discriminate against because you are pregnant. To do so, especially so badly, is just wrong. If you look at The pregnancy discrimination act which amended title VII of the civil rights act of 1964, you will see they have an obligation to treat you like a regular employee even when you need to take time off. you can file a lawsuit if they try and fire you or discriminate.
