Out On Workers Comp – Can I Get Fired?
I will be missing a total of 3 weeks ( if not more ) of work due to an injury my doc has determined is a result of work. I cannot return until getting some physical therapy which I can start as soon as it is approved. I am very nervous about losing my job though because I can’t work. My question is can they legally fire me over a workers comp injury? I love my job and am not prepared to lose it.

No, you cannot get fired while out on workers comp, nor can you be treated any differently when you return to work. You can’t be disciplined, fired, transferred or be given a different assignment. Any discrimination or retaliation towards you because you filed a claim is illegal. Also, keep your eye out for any bad treatment in the following months. Your boss may think he’s “out of the woods” because a couple of months have passed since your return and could decide to get even with you then. The court can see right through that.
