Panera Discriminates Against Men With Pierced Ears

 
 

 

I work at Panera and my manager told me today that guys aren’t allowed to have their ears pierced. (I just got mine pierced). I told him thats sexist and discrimination. He told me those are the rules.  Is it discrimination if girls are allowed to have ear piercings and guys arent, at work?  I’m thinking of complaining to EEOC. What should I do?

  • It’s sex-based discriminatory, but not the illegal kind. Body piercings don’t put you into any type of protected class.

    Here is when it becomes illegal:
    The law forbids discrimination when it comes to any aspect of employment, including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment.

    If the company manual said something like employees are allowed to have single ear piercings without mention of male or female and then your boss said guys can’t have piercings, then you’d have a legal claim, but not with the EEOC. However, I don’t know that any employment attorney would even want to represent such a case.
