Pregnancy Discrimination Lawsuit: How Much Should I Sue For?
I worked for a multi million dollar private company, I received a letter stating that they were terminating my position due to my pregnancy. I am due in August, and my doctor put me on TEMPORARY bed rest (5 weeks). After explaining to my employer, they agreed that it was fine (they give disability leave) it was just that once the baby came, I would only take the remainder of the 12 weeks allowed by NJ, which would’ve been 7 weeks off. I received this CERTIFIED letter in the mail 8 days after I was out, they only let one week go by and decided that they didn’t want me to leave again in august. I spoke to an attorney, and it is already in the process of being a lawsuit because they violated so many federal laws, however, I feel uncomfortable talking about money with my attorney because I just explained to my boss at FIRST, that I wanted to have my job and she turned me down. Now I wanna stick it to them, how much do you think that I can possibly walk away with?

Click here to read the EEOC’s definition of pregnancy discrimination. Print that page out and gently remind them how the law works. This happened to a dental hygienist at my dentist’s office. She was pregnant and they moved her to the front desk “for her own good and the babies health”. They didn’t want her around germy patients and the substances they use in dentistry. That move was straight up illegal, no matter now well intentioned. You CANNOT treat a woman any differently because she is pregnant.

I am 5 months pregnant and I am a bartender, my boss is trying to force me to become a cashier for less than 1/2 of what i make. I am lost and confused and super stressed that I need to fight for my job. I am thinking of suing but not sure how or for how much since it is a tip business. I also fear that a lawsuit will take such a long time to settle, and I like my job and dont want a bad relationship that comes with legal matters.
You feel uncomfortable talking about money with your attorney? Are you kidding me? If you don’t bring it up, your attorney will, believe me. Since the attorney is getting paid a percentage of your settlement, he/she will go for as much as is legally possible. Balls to the wall, man. Get as much as you can.
I can’t believe they actually sent you a letter and put it in writing. Guilty, guilty, guilty.

That depends on several things. 1- how much you were making before termination 2- how much they want to avoid bad publicity 3- how long you are willing to fight. But if you stick it out you could walk away with a LOT of money
You can’t just pick a random number–that’s not the way a lawsuit works.. However, you can ask for the equivalent of your potential wages. Not sure if you can receive wages for when you are on bed rest and maternity leave, but you will be able to receive for when you would have "came back." You might get up to a year, or maybe a bit more than that. It depends on how good your lawyer is.
Also, depending on what state you live in, you can collect money based upon discrimination. These fees vary from state to state, and can be as much as ten thousand dollars (or more) in some areas!
