Pregnant Wife Got Her Hours Cut

 
 

 

Her employer cut her hours because he said she is unable to handle longer shifts. From what I read he is not allowed to cut her hours, but I am unsure that I have a Human Resources case. can somebody please help with the legal issue?  Has my wife been violated under the Federal Pregnancy Discrimination Act?

  • If your wife got her hours cut as a direct result of her being pregnant and she didn’t request it, it smells of pregnancy discrimination. EVEN if the boss feels it is to her benefit to modify her work schedule because of her pregnancy, IT’S ILLEGAL!

    For instance, at my dentist office, one of the dental technicians got pregnant, therefore they moved her from assisting the dentist to working in the front office answering phones and dealing with insurance companies. EVEN THOUGH they felt it was in her best interest and for the safety of her health and unborn baby, IT WAS AN ILLEGAL MOVE. It doesn’t matter how well intentioned the reason was, it’s straight up illegal because they treated her differently because of her pregnancy.

    She needs to document what happened and file a claim with the EEOC or your state’s labor board. Start with the EEOC if the company has more than 15 employees. Click here to learn how to document.
