Unemployment: Got Laid Off, Can I Collect?

 
 

 

I worked at my old job for a yr. Can I get unemployment if i quit that job to work somewhere else, then got laid off at the new job within a month?

    Generally unemployment is only available if you’ve worked at the new job for minimum 6 months, but since you did have long-term employment before this one, you might still be eligible for unemployment. It is best to consult your state’s unemployment office, as each state has their own rules and policies. Just a heads up though — some states that have already used up their state budget for unemployment compensation, such as NJ and NC, may be stricter and less generous with giving out unemployment.

    If you were laid off due to lack of work, etc, – i.e. no fault of your own – then apply for unemployment insurance. You only quit your prior job to accept another job. You should have enough credits from the two jobs to get UI.

    However, your previous employer might object to your collecting UI against their account. You will have to prove you only quit to take the other job, and had a good reason (e.g. they offered more money, it was a promotion, etc) to believe it was a valid job offer. If the prior employer protests, be sure to appeal and prove you intended & believed the new job was permanent.
