Workers Comp Injury: Still Have Recurring Pain Months Later
About 8 months ago i was injured at my job. i got the workmens comp and shortly after that i quit because my supervisor told me my boss was planning on firing me when i was off of it. i still to this day get recurring pain with my neck and shoulder. its hard to do lifting. I’m not getting this pain everyday but enough to cause problems and the pain lasts for quiet awhile. I’m on my third day now with this pain. is it possible to still sue the company because its a recurring injury or will it be to hard because I’ve waited to long?

Did you file a workers comp claim for your injuries? If so, you relinquished your right to sue. If you want to be treated for your workplace injury, there is a time limit for filing a workers compensation claim for injuries on the job. It may be up to 2 years. Only a doctor can determine if you have permanent injuries, not you. Get the WC insurance company information from your former employer. Legally, they cannot prevent you from filing a claim. If you don’t want to file a claim and want to use your own doctor for treatment, then you’ll need an attorney to proceed with a lawsuit IF, IF the case has merit. Be prepared for a long battle that may last several years, many doctor appointments and lots of legal rangling. It’s illegal to fire anyone who files a workers comp claim solely because they filed a claim. You need to contact your state’s WC board to find out what the time period is. Even if you left the job, you might still be able to file another claim for the same injury. I have read where you have 2 years from the date of the accident to file a claim, but I’m not sure what state that was for.
