Workers Comp Only Paying 65% – Can I Sue For The Other 35%?
Due to company negligence (clear) injured at work. Only getting about 65% of base salary through workmens comp. Company short term disability no real help, only covers 66% and that is about what i get from workmens. Presently getting therapy trying to avert surgery for shoulder injury (MRI confirmed)…How and how and can i go after the 35% that i dont received due to someones negligence. Can i sue for difference – about 35%? I live in Texas

The thing with work comp is that exists, in part, so that employers can’t get sued. It covers your medical expenses and part of your salary. Whether you know it or not, by using it, you can’t sue.
