Marshall’s: Pregnant Women Told “We’re Not Hiring”
Ok so I am 5 months pregnant and am looking for a part time job. I went to Marshall’s to buy some newborn clothes, I asked a sales associate where they hiring…she said yes, very bad…..we need a lot of part time people. I then asked for an application. I sat in my car and filled it out then went back to give it to a manager. I asked the manager were they hiring and she said no, not at this time! I smiled and said ok thank you. I felt like I was turned down because of my pregnancy.
Answer: Pregnancy discrimination law forbids discrimination when it comes to any aspect of employment, including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, such as leave and health insurance, and any other term or condition of employment. http://www.eeoc.gov/laws/types/pregnancy.cfm
Do you have a friend who can fake looking for a job? Have your friend dress appropriately like they already work for Marshall’s. Then have your friend ask for the manager and find out if they are hiring. If your friend is told yes, then document it and file a pregnancy discrimination claim with the EEOC and nail those jerks. UPDATE: After looking at some of the comments below, I need to add something. YOU’RE ALL WRONG! You CANNOT treat a pregnant woman ANY differently than a “normal” employee. Even if there is standing all day and some heavy lifting, you CANNOT say “you shouldn’t/couldn’t do the job” IF THE REASON IS BECAUSE SHE IS PREGNANT. I have given this example before and I will do it again. At my dentist office, one of the dental assistants got pregnant. They moved her from assisting the dentist to the front office because they felt being around open mouth procedures and some of the compounds she had to work with would put her pregnancy at risk. As well intended as that may sound because her boss was “looking out for her”, IT WAS STRAIGHT UP ILLEGAL because they treated her differently soley because of her pregnancy. http://www.eeoc.gov/laws/types/pregnancy.cfm
