Firing An Employee After A Sexual Harassment Claim

 

A Reader Asks This Question:

Can you legally fire someone who had made a formal, though unsubstantiated, sexual harassment claim?…If their work performance is sub par and they’ve been disciplined, in writing, for insubordination and inattention to duty?

Basically she made the claim because she feels everyone wants her and is watching her. There is no evidence of sexual harassment and it would be completely out of character of the accused and she basically made it a “blanket” statement to include all her male supervisors.
