Injured at work then terminated – Can I collect workman comp?
I was allowed to work light duty then terminated. so can I collect workman comp?
Answer: I think you are confusing workers’ compensation with unemployment. First off, did you file a workers’ comp claim for your injury? Is that why you were put on light duty? Just the simple act of filing a workers’ comp claim puts you in a protected class and free of retaliation. A lot of times employers will try to cover it up by using some excuse like “you came in late” to make it sound legit, but that’s still illegal. Also, if you got fired, chances are pretty good you cannot collect unemployment, but you don’t state why you were fired. If it’s because you were on light duty, then you should be able to get it, but you’ve got to have your facts straight for the unemployment office.
